Under Florida DUI law, refusal to submit to a breathalyzer test may be admissible as evidence. Typically, the refusal will be used as circumstantial evidence of guilt by the prosecutor. However, a refusal without more may also carry severe consequences.

If the driver has previous DUI convictions he will be required to complete the Level 2 course. The Level 2 course requires the driver to spend at least 21 hours of classroom time in an approved educational facility.

Under Florida DUI law, the court may require a person convicted of a DUI to install an ignition interlock device in their vehicle. The ignition interlock device is similar to the breathalyzer test used by police officers.
